Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Essentify website at essentify.ai and related services (the "Service"), operated by Kevin Neamt, a sole proprietor based in Illinois, United States ("Essentify," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date. Notify us promptly at support@essentify.ai if you suspect any unauthorized use of your account.

3. The Service

Essentify allows you to record, organize, and access maintenance history for devices and systems in your home or property, including through QR codes. We may add, change, or remove features of the Service at any time.

4. Subscriptions, Billing, and Refunds

The Service offers free and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly or yearly, as you select) through our payment processor, Stripe.

Auto-renewal. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

Cancellation. You may cancel your subscription at any time. When you cancel, your paid access continues until the end of your current paid billing period, after which it will not renew. You will not be charged again after cancellation.

No refunds. All payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or unused features, except where required by law.

Price changes. We may change our subscription prices. We will give you reasonable notice of any price change, and changes will apply to your next billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Upload or transmit malicious code, or attempt to harm the Service or other users;
  • Reverse engineer, copy, or resell the Service without our permission;
  • Use the Service to store or share content that is illegal, infringing, or harmful.

We may suspend or terminate your access if you violate these Terms.

6. Your Content

You retain ownership of the data and content you submit to the Service, including your device and maintenance information ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to provide the Service to you.

You are responsible for Your Content and for ensuring you have the right to submit it. We are not responsible for the accuracy of maintenance records or other information you enter.

7. Intellectual Property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by Essentify and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Third-Party Services

The Service relies on third-party providers, including Supabase, Stripe, and Google. Your use of those services through Essentify may also be subject to their respective terms and policies. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements. Essentify is a record-keeping tool and does not provide professional maintenance, safety, or inspection advice. You are responsible for the actual maintenance and safety of your property.

10. Limitation of Liability

To the maximum extent permitted by law, Essentify and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Essentify and its operator from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and we may delete Your Content in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of laws principles. Any disputes arising under these Terms will be subject to the jurisdiction of the courts located in Illinois.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
